Terms of Use and End User License Agreement

These Terms of Use and End User License Agreement ("Terms") govern your access to and use of the Moorion mobile application, website, content, subscriptions, maps, chart-derived data, tools, and related services (collectively, "Moorion" or the "Service").
Moorion is provided by Maritime Technology d.o.o. ("Maritime Technology", "we", "us", or "our"). You can contact us at support@moorion.com.
By downloading, accessing, subscribing to, or using Moorion, you agree to these Terms. If you do not agree, do not use Moorion.
1. Important Safety Notice
Moorion is a secondary aid for recreational boating, route planning, anchoring, voyage tracking, logbook, and educational use. Moorion is not for primary navigation.
Moorion does not replace official nautical charts, Electronic Navigational Charts (ENCs), Notices to Mariners, Notices to Skippers, light lists, tide tables, weather warnings, local regulations, marina or harbour notices, visual observations, depth sounders, radar, AIS, VHF communications, prudent seamanship, or the independent judgment of the vessel's captain, skipper, master, operator, or crew.
You are solely responsible for safe navigation, voyage planning, watchkeeping, vessel operation, compliance with applicable laws and regulations, and maintaining appropriate official charts, equipment, backup systems, and safety procedures.
Moorion is not designed, certified, approved, or accepted for SOLAS vessels, ECDIS use, commercial carriage requirements, regulated professional navigation, emergency, distress, rescue, or life-safety use. Do not rely on Moorion where failure, delay, inaccuracy, interruption, device loss, battery failure, GPS error, notification failure, water damage, or loss of network access could lead to death, personal injury, grounding, collision, property damage, environmental damage, regulatory breach, or other serious loss.
You use Moorion at your own risk.
2. Eligibility
Moorion is not directed to children under 13. If you are under 13, you may not use Moorion. If you are under the age of majority or under the digital consent age in your country, you may use Moorion only with permission and supervision from a parent or legal guardian.
Moorion is not part of Apple's Kids Category and is not intended as a child-directed service.
3. License to Use Moorion
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use Moorion on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions and the App Store usage rules.
You may not copy, modify, reverse engineer, decompile, disassemble, scrape, misuse, interfere with, resell, sublicense, distribute, or create competing datasets or services from Moorion except where applicable law expressly allows it.
4. Apple App Store Terms
These Terms are between you and Maritime Technology only, not Apple. We are solely responsible for Moorion and its content, maintenance, support, warranties to the extent not disclaimed, and claims relating to Moorion.
Apple has no obligation to provide maintenance or support for Moorion. If Moorion fails to conform to any applicable warranty that cannot be disclaimed, you may notify Apple, and Apple may refund the purchase price, if any, in accordance with Apple's policies. To the maximum extent permitted by law, Apple has no other warranty obligation for Moorion.
You and we acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.
You represent that you are not located in a country or territory subject to applicable embargo or sanctions restrictions and are not listed on any applicable prohibited or restricted party list.
5. Moorion Features
Depending on your version, subscription, device, permissions, region, and connectivity, Moorion may include maps, chart-derived data, route planning by user-created points, voyage tracking, anchor alarm, logbook, PDF export, tips, quizzes, light signal tools using the device flashlight, bug reporting, and related features.
Moorion may change, suspend, remove, limit, or add features at any time. Map and data coverage may vary by country and region. Chart-derived coverage focuses on New Zealand and the United States, even if the app is available in other countries.
6. Maps, Routes, and Data
Moorion may display data from third-party providers including Mapbox, OpenStreetMap, Toitū Te Whenua Land Information New Zealand / LINZ, the National Oceanic and Atmospheric Administration / NOAA, the U.S. Fish and Wildlife Service, and other sources. Third-party notices are available in Moorion's Third Party Notices.
Map, depth, shoreline, restricted zone, anchoring restriction, hazard, aid-to-navigation, and other marine information may be incomplete, inaccurate, outdated, generalized, misinterpreted, delayed, unavailable, or affected by processing, styling, conversion, zoom level, device display, or data source limitations.
Routes are user-created routes based on points placed by the user. Moorion does not provide automatic safe routing and does not confirm that a route is safe, legal, passable, deep enough, current, or suitable for your vessel, crew, weather, tides, local rules, or conditions.
You must independently verify all route plans and displayed information with official sources and real-world observations before and during any voyage.
7. Anchor Alarm
The anchor alarm is a supplemental alerting tool only. It is not a substitute for proper anchoring technique, anchor watch, seamanship, visual checks, depth checks, weather monitoring, or other onboard safety practices.
Anchor alarm performance may depend on GPS accuracy, device location permissions, background execution, iOS settings, notification settings, volume, vibration, Focus modes, battery level, Low Power Mode, network conditions, device placement, device damage, and other factors outside our control.
We do not guarantee that Moorion will detect anchor drag, trigger an alarm, remain active in the background, sound audibly, vibrate, notify you, or prevent grounding, collision, property damage, injury, or loss.
8. Voyage Tracking, Logbook, and PDF Export
Voyage tracking, route history, logbook entries, screenshots, and PDF exports are provided for convenience, memory, planning, and record-keeping. They are not official nautical records, regulatory records, commercial voyage documents, navigation records, or evidence of safe operation.
You are responsible for verifying, preserving, exporting, and backing up any information you need. Local app data may be lost if the app is deleted, the device is lost, device storage fails, or the operating system removes app data.
9. Light Signal and Educational Content
Tips, quizzes, educational content, and flashlight light signal tools are provided for general learning and convenience. They may be incomplete, simplified, localized, delayed, or unsuitable for a particular situation.
The flashlight feature does not guarantee legal compliance, visibility, timing accuracy, recognition by other vessels, or suitability for emergency signaling. You must follow COLREGs, local rules, official training, onboard equipment requirements, and the captain's judgment.
10. Subscriptions and Payments
Moorion offers paid subscriptions, including Moorion Pro. Subscriptions include an annual subscription with a 3-day free trial and a monthly subscription. U.S. reference prices are USD 59.99 per year and USD 14.99 per month, but actual prices may vary by country, currency, tax, promotion, App Store setting, and time.
Subscriptions are processed by Apple through the App Store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged according to Apple's rules. You can manage or cancel subscriptions in your Apple account settings.
Free trials convert to paid subscriptions unless cancelled before the trial ends. Restore Purchases functionality is available in the app. Family Sharing is not supported unless shown otherwise in the App Store.
Refunds are handled by Apple according to Apple's policies. We cannot guarantee that Apple will grant a refund.
11. Acceptable Use
You agree not to:
- use Moorion for primary navigation, SOLAS, ECDIS, regulated professional navigation, emergency, distress, rescue, or life-safety purposes;
- use Moorion in a way that violates maritime laws, sanctions, export controls, local rules, safety regulations, or third-party rights;
- attempt to extract, scrape, copy, cache, bulk download, reconstruct, resell, or redistribute map tiles, chart-derived data, datasets, styles, or content except as expressly allowed;
- interfere with Moorion, its SDKs, servers, security, billing, subscriptions, or attribution systems;
- submit unlawful, harmful, misleading, infringing, or malicious content through support or bug reports;
- bypass paywalls, entitlement checks, App Store rules, or access controls.
12. User Data and Content
You are responsible for content and data you enter, create, save, attach, export, or send through Moorion, including profile information, vessel information, routes, logbook entries, bug reports, screenshots, PDFs, and attachments.
You grant us the limited rights necessary to process information you intentionally send to us, such as support emails and bug reports, so we can provide support, diagnose issues, improve Moorion, comply with law, and protect our rights.
Most app-created boating data remains on your device unless you choose to export, share, or send it. See the Privacy Policy for details.
13. Third-Party Services and Terms
Moorion uses third-party services and SDKs, which may include Apple, RevenueCat, Firebase / Google, Mapbox, AppsFlyer, Amplitude, email/support providers, hosting providers, and data providers. Your use of Moorion may be subject to third-party terms, privacy policies, licenses, attribution requirements, and technical limitations.
Third-party services may change, become unavailable, impose restrictions, or process data according to their own terms and privacy policies. We are not responsible for third-party services except to the extent required by applicable law.
14. Intellectual Property
Moorion, including its app design, code, interface, branding, text, graphics, generated styles, and proprietary content, is owned by Maritime Technology or its licensors and is protected by intellectual property laws.
Third-party maps, chart-derived data, open-source software, SDKs, icons, fonts, and other materials remain the property of their respective owners and are used under applicable licenses or terms.
No rights are granted except as expressly stated in these Terms.
15. Disclaimers
To the maximum extent permitted by law, Moorion is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of accuracy, completeness, timeliness, reliability, availability, merchantability, fitness for a particular purpose, title, non-infringement, safety, suitability for navigation, or uninterrupted or error-free operation.
We do not warrant that Moorion, maps, data, routes, anchor alarms, notifications, subscriptions, content, support, or third-party services will meet your needs or prevent harm.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
16. Limitation of Liability
To the maximum extent permitted by law, Maritime Technology, its officers, directors, employees, contractors, affiliates, suppliers, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for loss of profits, revenue, data, goodwill, vessel use, voyage opportunity, holiday value, business opportunity, or property, arising from or related to Moorion.
To the maximum extent permitted by law, we will not be liable for injury, death, grounding, collision, allision, stranding, capsizing, environmental damage, vessel damage, equipment damage, fines, regulatory action, delay, missed arrival or departure, rescue costs, towing costs, fuel costs, marina costs, charter losses, or other loss arising from reliance on Moorion, map or data errors, route planning, anchor alarm failure, device failure, GPS error, weather, tides, local conditions, or third-party services.
Where liability cannot be fully excluded, our total liability will be limited to the greater of: (a) the amount you paid to us through the App Store for Moorion in the 12 months before the event giving rise to the claim; or (b) EUR 50.
Consumer rights that cannot be waived under applicable law remain unaffected.
17. Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold harmless Maritime Technology from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your misuse of Moorion, violation of these Terms, violation of law, unsafe operation, reliance on Moorion for primary navigation or safety-critical use, or infringement of third-party rights.
This section does not apply where prohibited by applicable consumer law.
18. Changes to Moorion or These Terms
We may update Moorion and these Terms from time to time. Material changes will be posted in the app or on our website where appropriate. The "Last updated" date shows when these Terms were last changed.
If you continue using Moorion after changes take effect, you accept the updated Terms. If you do not agree, stop using Moorion and cancel any subscription through Apple.
19. Suspension and Termination
We may suspend or terminate access to Moorion if we reasonably believe you violated these Terms, misused the Service, created risk, violated law, or if required by Apple, a provider, or applicable law.
You may stop using Moorion at any time. Deleting the app does not automatically cancel an App Store subscription; you must cancel subscriptions in your Apple account settings.
20. Governing Law and Disputes
These Terms are governed by the laws of Croatia, without regard to conflict-of-law rules.
If you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protection rights, you may have rights under the mandatory laws of your place of residence, and nothing in these Terms deprives you of those rights.
Subject to mandatory consumer rights, disputes arising from or relating to these Terms or Moorion will be submitted to the competent courts of Croatia.
European Union consumers may also have access to alternative dispute resolution rights where applicable.
